After TiVo Inc. last week won a patent infringement suit against EchoStar Communications (EchoStar is appealing), a different court has stayed EchoStar’s countersuit against both TiVo and its manufacturing partner, Humax USA.
EchoStar accused TiVo and Humax USA of infringing several of its patents. Judge Caroline M. Craven of the United States District Court, Eastern District of Texas, issued a stay order.
The litigation now awaits the outcome of a re-examination of EchoStar patents by the U.S. Patent and Trademark Office. TiVo is claiming the EchoStar patents are invalid on the basis of several prior art references the USPTO did not previously consider.
